The requirements of the Bank Secrecy Act (BSA) are effective for all financial institutions and compliance is mandatory. Those responsible for BSA compliance are required to receive specialized training, as they hold a tremendous amount of responsibility to ensure their institution remain compliant with the Act.
Failure to comply with the BSA can have serious consequences and can lead to hefty monetary penalties, cease and desist orders, imprisonment and also the removal of individuals from the banking industry for a violation of the Anti-Money Laundering Laws.
As the current BSA Examination Manual states “The appointment of a BSA compliance officer is not sufficient to meet the regulatory requirement if that person does not have the expertise, authority or time to satisfactorily complete the job.”
