FACT Act-Understanding and Complying with NCUA's Affiliate Marketing Rule

The final FACT Act regulation regarding how your credit unions and their affiliates/CUSOs use member/consumer information for marketing purposes has been issued and the compliance deadline is on the horizon. The final rules generally prohibit a credit union from using information received from an affiliate to make a solicitation for marketing purposes to a member or consumer, unless that person is given notice and a reasonable opportunity and a reasonable and simple method to opt out of the making of such solicitations.
This new law becomes effective on January 1, 2008, with a mandatory compliance date of October 1, 2008.
