The final FACT Act regulation regarding how your credit unions and their affiliates/CUSOs use member/consumer information for marketing purposes has been issued and the compliance deadline is on the horizon. The final rules generally prohibit a credit union from using information received from an affiliate to make a solicitation for marketing purposes to a member or consumer, unless that person is given notice and a reasonable opportunity and a reasonable and simple method to opt out of the making of such solicitations.

This new law becomes effective on January 1, 2008, with a mandatory compliance date of October 1, 2008.

Please join us for a webcast that will help you better understand the affiliate marketing regulation and address the following issues:

·        Determining whether the rule affects your credit union

·        Information covered under the rule

·        Marketing restrictions, and available exceptions

·        Required disclosures, and who must make them

·        How the regulations interact with NCUA's Privacy Rule

Even if your credit union doesn't have a CUSO or affiliate now, you need to understand this rule if your credit union is thinking of adding an affiliate or CUSO in the future.
