Credit CARD Act of 2009 & Final Rules on UDAP and Regulation Z: How the Changes Will Impact Your Credit Card Programs

Presented by Oliver Ireland, Partner, Morrison & Foerster; and Obrea Poindexter, of Counsel, Morrison & Foerster

 

The Credit CARD Act of 2009 and the final rules and changes for UDAP and Reg Z will affect every aspect of credit card operations, including pricing, disclosures (including cardholder agreements, solicitations and billing statements), programming, billing policies and advertising practices. Issuers will need to understand the impact of these changes on their portfolio and servicing, assess the need to restructure portfolios or product offerings and the implications of such restructuring.

 

International ACH Transactions: The New Compliance Issues That Will Affect Your Credit Union

Presented by Dennis Simmons, AAP, President and CEO, SWACHA – The Electronic Payments Resource

 

International ACH Transactions (IAT) will become effective on September 18, 2009. With this new ACH application, comes major compliance issues that will affect every financial institution in the country. OFAC is mandating that financial institutions be able to detect and control international payments and ACH. Learn about the changes that are required for effective transaction processing which include software changes, policy and procedural changes as well as OFAC screening requirements. You may be thinking that these changes will not affect your credit union because you don't receive or originate international ACH transactions. OFAC estimates that there are 40 million transactions annually that should be classified as IAT and you may be receiving these transactions today. Compliance with and acceptance of these transactions is mandatory.

 

Mortgage Workouts, Modifications and Re-ages— What’s Best for Your Member?

With all of the buzz around the government’s efforts to help people stay in their homes, credit union lenders and compliance professionals need to know what programs are out their to help their members. For instance, are your members who are in need of relief eligible for a workout? How does this compare with refinancing and what is right for your credit union member? Find out what documentation you need for a workout, how to coordinate between departments and NCUA’s concerns with this new credit practice. We will also discuss the Home Affordable Modification Program (HMP), how you comply with the program guideline, modification options and more!

 

 

Amendments to Reg E, Truth in Savings Act and Other Courtesy Overdraft Issues

Presented by Mitchell B. Klein, Esq., NCCO, Police & Fire Federal Credit Union

 

The Federal Reserve Board has proposed changes to the way credit unions handle the overdraft of members’ accounts through electronic transactions. Regulation E changes that are being proposed include the members’ ability to opt in or opt out and whether credit unions will be prohibited from assessing an overdraft fee if the overdraft would have occurred because of a debit card hold. Truth in Savings Act changes on the table include; disclosures on periodic statements, account balance disclosures and fee disclosures. This session will explain how to comply with these and other courtesy overdraft issues.

 

Regulatory Advocacy- Stand Up and Make Your Job Uncomplicated

Most compliance professionals spend the majority of their time “putting out fires” or otherwise handling the minute-to-minute challenges of their compliance responsibilities. Often overlooked in this commotion is the opportunity to advocate our regulators for a more reasonable approach to regulation. In this presentation, we will go over some good ways to justify regulatory advocacy to other senior managers, determine who in the credit union should be an advocate, locate advocacy resources, analyze a proposed regulation and how write a regulatory advocacy letter.

 

Using  Enterprise Risk Management to Improve Operations, Accountability, Liquidity and Regulatory Compliance

The business environment is rapidly changing, and credit unions are exposed to a great deal of liquidity, reputation, strategic and audit risk. Many of these risks can have a direct impact on the financial soundness of the institution. Credit unions that implement successful ERM programs are better positioned to improve operations, protect their assets, manage liquidity and provide excellent services to the members. This session will give attendees a new approach for analyzing and managing their risks by implementing a cost effective and well organized Enterprise Risk Management program.

The Francis Marion Hotel, 387 King Street, Charleston, SC 29403

The historic Francis Marion Hotel, named for the Revolutionary War hero Francis Marion, the "Swamp Fox," has a long tradition of gracious service, elegant accommodations, and hosting splendid banquets and events dating back to its opening in 1924. Built by local investors at a cost of $1.5 million from plans by noted New York architect W.L. Stoddard, the Francis Marion was the largest and grandest hotel in the Carolinas. The 1920s was the Golden Age of railroads, radio and grand hotels, and the Charleston Renaissance was in full bloom and the Francis Marion Hotel was "the place to be."

Meticulously restored in 1996 with a $12 million National Trust for Historic Preservation award winning restoration, the Francis Marion Hotel now combines 1920's style and grace with 21st Century comfort and convenience in the heart of historic Charleston on Marion Square. Rising 12 stories, many of the Hotel's 226 guestrooms and suites offer spectacular views of Charleston's historic harbor, church steeples and legendary King Street. The Francis Marion Hotel, with its central downtown location, is an easy walk to the antebellum homes, magnificent gardens, antique shops and boutiques, and world-class restaurants.

From Charleston International Airport
Exit airport on International Drive and Follow signs for I-526 to Mt. Pleasant. From I-526 follow signs for I-26 East to Charleston.

From I-26 Headed East
Travel on I-26 to the end (Meeting Street Exit). Turn right onto Meeting Street. Stay on Meeting Street in the right hand lane for .6 miles. Pass the Charleston Visitor’s Center and turn right at the light, which is John Street. Take John Street one block to King Street and turn left on King Street. The Francis Marion Hotel is on the right.

From Hwy 17 Headed North
Follow Hwy 17 (Savannah Hwy) North and cross the Ashley River Bridge onto the peninsula. Hwy 17 will make a sharp turn to the left as it forks with Cannon Street. Follow the sign for Cannon Street. Take Cannon Street until it ends at King Street. Turn right onto King Street. The Francis Marion is approximately 6 blocks on the right.

From Hwy 17 Headed South
Follow Hwy 17 (Johnnie Dodds Blvd.) South and cross the new Arthur Ravenel Jr. Bridge also known as the Cooper River bridge. Stay in right hand lane and take the Meeting Street Exit. At the traffic light, turn left onto Meeting Street. Stay on Meeting Street in the right hand lane for .6 miles. Pass the Charleston Visitor’s Center and turn right at the light, which is John Street. Take John Street one block to King Street and turn left on King Street. The Francis Marion Hotel is on the right.

Our guests may pull up to the front door on King Street for unloading and check-in, our bell-staff will be happy to assist you.

Parking
Valet parking is available at a $17 per day charge that will be automatically charged to your room bill.

Self-parking is available in the City Garage located next door to the Hotel. The charge is $12 per 24 hour period and is payable to the garage attendant in cash.

The Hampton Inn Charleston - Historic District, 337 Meeting Street

 

The Hampton Inn Charleston-Historic District hotel is located in the heart of Downtown Charleston, South Carolina. The hotel is adjacent to the Charleston Visitors Center and Charleston Museum. This Award-Winning hotel is the only antebellum hotel located in the Charleston Historic District.

From Airport
