CFPB rule defines when a rule is ‘issued’

Jan. 3, 2013 – A recent final rule from the CFPB says its final rules are considered “issued” on the earlier of the rules’ posting on the bureau’s website or publication in the Federal Register.

Given that this rule wasn’t posted first on the bureau’s website, it is considered to have been issued as of Dec. 28, the date of its publication in the Federal Register.

The CFPB says the definition of when a rule is issued has legal consequences, and the bureau generally intends to issue rules by posting them on its website. The date of posting will be the date they are deemed “issued.” If they are published first in the Federal Register, however, they will be considered issued as of the date of publication there.
