Congress passes SCRA extension
Congress on Friday passed a one-year extension of the Servicemembers Civil Relief Act's post-service mortgage protections, which protects servicemembers from foreclosure on their homes for one year after leaving service.
The protections for servicemembers had been due to expire this year-end. They are extended to year-end 2015 under S. 3008, the "Foreclosure Relief and Extension for Servicemembers Act," which is ready for the president's signature.
The Honoring America's Veterans and Caring for Camp Lejeune Families Act was last revised in 2012. The protection is augmented by a required disclosure to servicemembers that details their legal rights and protections.
Servicemembers have numerous credit protections under SCRA. With respect to foreclosure, the HUD form points out that "the sale, foreclosure, or seizure of real estate shall not be valid if it occurs during, or within one year after the servicemember's military service unless the creditor has obtained a valid court order."
