On August 4, 2016, the Consumer Financial Protection Bureau (CFPB) issued its new 2016 Mortgage Servicing Rule based upon its November 2014 proposed rule changes.  The new rule is likely to have a significant impact on your mortgage programs with revisions including:

  • Expansion of the rule to cover "successors in interest" who receive mortgaged property pursuant to death or divorce of the original borrower
  • New force-placed insurance disclosures
  • Revised loss mitigation application and evaluation requirements
  • New periodic statement requirements for modification, temporary loss mitigation and bankruptcy
  • A new interpretive rule on interaction of the FDCPA with the Regulation X and Regulation Z

Although most of the new requirements are not effective until October 19, 2017, our experiences with the CFPB have taught us that it's best to begin implementing reviews and processes early rather than wait to implement changes within tight timeframes.
