Useful Fair Lending Guidance; Consumer Complaints

NCUA released fair lending guidance in 2009 in the form of Interagency Fair Lending Examination Procedures. You can find it in 09-RA-09. If you find yourself in need of a brief refresher the Introduction provides a short and sweet overview of the fair lending highlights, including examples of disparate treatment and disparate impact. If you need to develop fair lending training, this may be a good place to start. And if you enjoy the scare tactic method of training, you can always go to DOJ's fair lending page and pull out some nuggets from some of the more recent fair lending cases.

 

The CFPB has released more information on what they will be doing with consumer complaints. To satisfy a requirement from the Dodd-Frank act that it share consumer complaint information with the FTC, the CFPB has entered into an agreement with the FTC. Pursuant to the agreement the CFPB will share complaint information with the FTC's Consumer Sentinel system. This is an online database, a compilation of consumer complaints, is maintained by the FTC, and can be accessed by law enforcement.
