Florida robocall bill signed by Gov. DeSantis

PhoneFlorida Gov. Ron DeSantis earlier this week signed Florida's robocall bill into law after being presented the bill on Monday; the bill became effective July 1. Of note, the bill includes language to provide an exemption for financial institutions operating within "the scope of supervised activity."

Unlike the Telephone Consumer Protection Act (TCPA), the bill does not define "automated system."

In addition, the bill adds a private right of action to the state's existing anti-robocall law and requires callers to collect a customer's express written consent before placing any marketing calls to consumers via an automated dialing system.

The association has actively worked with the FCC on efforts to modernize the TCPA for many years and has continuously called for the agency to protect legitimate callers and ensure consumers receive important information following the FCC's recent order and fourth further notice of proposed rulemaking (FNPR) on methods to target and eliminate unlawful robocalls.

NAFCU has consistently raised concerns about the litigation risks associated with the TCPA and will continue its advocacy to ensure credit unions can contact their members regarding important, time-sensitive information, without fear of frivolous litigation.
