New Reg Alert breaks down HUD proposal

Regulatory AlertThe Department of Housing and Urban Development (HUD) issued a proposed rule to rescind its 2020 final rule to amend the Fair Housing Act's disparate impact standard and restore the 2013 discriminatory effects rule. In a new Regulatory Alert sent to members Monday, NAFCU seeks credit union feedback on the proposal.

The Regulatory Alert details how the issue impacts credit unions and outlines questions for credit unions to consider when providing feedback on this topic, including whether or not the reinstatement of the 2013 regulation might create additional uncertainty regarding application of the discriminatory effects doctrine.

NAFCU last week met with staff from HUD to discuss mortgage lending trends in the credit union industry and will continue to work with HUD to monitor the housing finance landscape and keep credit unions informed of policy changes.
