Compliance experts dive into ADA, HMDA, reg landscape

With the theme of Regulatory Update Day, students at today's NAFCU Regulatory Compliance School in Arlington, Va., will hear the latest on the NCUA and CFPB, website compliance under the Americans with Disabilities Act (ADA), and the Home Mortgage Disclosure Act (HMDA).

Students this morning also have the opportunity to take the third of four exams to become a NAFCU Certified Compliance Officer (NCCO).

On the agenda at School today:

  • NCUA and CFPB update: NAFCU Director of Regulatory Affairs Alexander Monterrubio will discuss the political landscape in Washington before he dives into the priorities and rulemakings of the CFPB and NCUA. He will also talk about other agencies and issues relating to housing finance reform, tax reform and fintech.
  • Bankruptcy collections: David Reed, partner with Reed & Jolly, will discuss bankruptcy basic and compliance with the Fair Debt Collection Practices Act (FDCPA) for credit unions. He will also note the various regulatory obligations credit unions may need to take, including changing business plans, product lines, policies and procedures, amending certain forms, and training staff.
  • Cybersecurity: John Moeller, principal with CliftonLarsonAllen, will highlight the most recent cybersecurity data from 2017, Financial Services Sector Coordinating Council (FSSCC) cybersecurity assessment tool best practices, and ensure senior management and other credit union leaders understand cybersecurity risks.
  • HMDA: NAFCU Vice President of Regulatory Compliance Brandy Bruyere will lead a discussion with three credit unions on implementing the updated HMDA rule. The panel will discuss operational challenges and best practices on implementation within their organizations.
  • ADA compliance: Jamie A. LaPlante, partner at Porter Wright Morris & Arthur LLP, will give an overview of ADA and public accommodations, how the ADA applies to websites and apps, the shift to enforcement by plaintiffs' attorneys, common issues with financial institutions' websites, and what credit unions can do to comply and mitigate risks.
